A Summary of Raila Odinga and Martha Karua Petition in The Supreme Court.

In the petition filed at the Supreme Court on 22nd August 2022, Raila Odinga and Martha Karua the respondents include the IEBC  commission, Wafula Chebukati the chairman of the commission, and the six commissioners, and William Ruto who was declared president-elect on August 15th.


James Orengo yesterday intimated that the petitioners had asked for a cocktail of prayers from the Supreme Court.

The petition filed cited:


1)• A violation of and /or lack of an electoral system and process that is conducted by an independent body; transparent; and administered in an impartial, neutral, efficient, accurate, and accountable manner. 

• Usurpation of the constitutional mandate of the IEBC by the 2nd Respondent (Wafula Chebukati.

• Lack of transparency and accountability at the National Tallying Centre. 

•Lack of accuracy, verifiability, and accountability of the Voter Turnout data/information

• Inconsistencies in official reports of the Voter Turnout

• Non-qualification of 50% plus one requirement  


2). Lack of Security of IEBC election materials, systems, and devices and interference through foreign nationals. Manipulation of voter Turnout-KIEMS kits –Vs- Form 34C • Three Venezuelan nationals had super administrator rights to IEBC IDMs, and 19 other foreign nationals had administrator rights to IEBC systems through which they could remotely access and manipulate entire IEBC data.

 • Evidence of Staging-( temporary storage of Form 34A in an external address to allow an interceptor to manipulate the forms before re-uploading them), for example, on 11th August 2022 IEBC dumped over 11,000 Forms 34A into the public portal between 1101hrs- 1109hrs


 3). Sabotage, criminal and/or fraudulent interference, deliberate tampering with and/or manipulation of election results and returns. Fraudulent establishment of parallel Form 34A, Manipulation and/or deliberate tampering with Forms 34A-( evidence from a sample of 41 Forms 34A from Bomet and Kiambu Counties) There was fraudulent digital manipulation of Forms 34A- (hackers contracted by Dennis Itumbi- affidavit annexed to that effect).


4). Vote discrepancies. Variances in votes cast for the presidential position and the other three positions of Governor, Senator, and Women Representative. The petition also cites voter suppression in Raila strongholds, Ballot stuffing in Ruto strongholds, Cancellation of Gubernatorial elections for ulterior motives- (Mombasa & Kakamega-Raila Strongholds), and failure in KIEMS kits (Kakamega & Makueni –strategy to suppress voter turnout in AZIMIO strongholds)


 5)According to the Forensics analysis of the 2022  presidential election, Professor Walter Richard Mebane, an expert concluded that there was indeed electoral fraud.
