City Lawyer Philip Murgor To Sue NCBA Over 1300 Fuliza Loan CRB Listing


Popular and top legal mind Philip Murgor has threatened to move to court seeking redress over the erroneous listing by NCBA Bank over a 1300 shillings overdue loan.

He claims that the bank failed to perform due diligence before listing him as a loan defaulter.


The senior counsel has accused NCBA of failing to verify the information causing him to appear on the Credit Reference Bureau listing.

Philip Murgor added that as a result of the negative listing, efforts to secure insurance for his law firm Murgor and Murgor Advocates have been fruitless.

Murgor was seeking finances to the tune of  403,000 shillings from NCBA bank to service his firm's insurance premiums.

His application was declined for the reason of the outstanding Fuliza loan.


NCBA listed Philip Murgor on the 7th of May 2021 after a number registered under his identification card failed to service a Fuliza loan that amounted to 1300 shillings.

Fuliza loans are a bank overdraft service offered by telecom service provider Safaricom in partnership with NCBA bank as well as KCB bank. It enables subscribers to complete transactions even with deficient funds. The loan is usually payable within a given period.

“NCBA at all material times failed to exercise reasonable skill and care before forwarding the false reports about our client for publication and general circulation, as it took no steps to ascertain whether or not our client had indeed opened, or operated a Fuliza overdraft account” read part of the letter addressed to NCBA bank by Murgor and Murgor advocates.

In rebuttal, NCBA insists that it relied on information that was at its disposal to make the negative CRB listing and should therefore not be held liable for listing Philip Murgor.

"In light of the foregoing, we regret to advise that your client’s claim cannot be admitted and is hereby denied,”

NCBA bank also stated that it used the phone number used to complete the transaction to convey important communication.

NCBA bank further added that following Mr.Murgor's complaint it conducted an inquiry that led the bank into directing the CRB to remove the listing of Philip Murgor as a defaulter.
