Moses Kuria’s Petition Against Raila Odinga

In the petition, Moses Kuria and former Mbeere South MP  Geoffrey King’angi allege that Raila Odinga through his chief agent Saitabao Ole Kanchory caused chaos at the Bomas of Kenya during the tallying of presidential results.

Kuria alleges that he should not be granted any sort of relief by the Supreme Court.


Moses Kuria is the former Member of Parliament for Gatundu. He failed to clinch the governor’s seat in Kiambu County. He is the Chama Cha Kazi Party Leader.


Moses Kuria accuses Mr.Raila Odinga of inciting his chief agent to cause chaos at the IEBC tallying center on 15th August shortly before Chebukati announced the president-elect.


Mr.Kuria has alleged that Raila’s agent physically assaulted IEBC chairman Wafula Chebukati with the intent of barring the chairman from declaring the results.


“Shortly after entry of the Commission’s Chairman two other commissioners and the Chief Executive Officers, one Satiabao Ole Kanchori and Narok County Senator-Elect, Honourable Ledama Ole Kina who was also an accredited agent of the 1st and 2nd 10 Respondents gained access to the podium whereby he threatened and physically assaulted the Chairman and the commissioners in the full glare of cameras” Kuria stated.


Odinga himself has filed a petition at the Supreme court seeking the announcement of William Ruto to be dismissed as null and void citing election irregularities and illegalities.


Moses Kuria and Geoffrey King’angi therefore on these grounds want the former Prime Minister to foot the bill of his petitions and his petition dismissed by the Supreme Court of Kenya.


The two petitioners also want the Director of Criminal Investigations and the Director of Public Prosecutions to lodge investigations against Raila Odinga and his chief agents alongside Narok Senator Ledama Olekina.


The chairman Mr.Wafula Chebukati would later announce that he was under a lot of intimidation and threats while performing this constitutional duty which compelled him to announce the results under heavy security.


The electoral Code of Conduct requires political parties, independent candidates, and all persons participating in the elections to comply with the said code.


a) publicly and repeatedly condemn violence and intimidation and avoid the use of hate speech, language, or any kind of action which may lead to violence or intimidation, whether to demonstrate party strength, gain any kind of advantage, or for any other reason.

 (b) refrain from any action involving violence or intimidation

 (c) ensure that no arms or weapons of any kind are carried or displayed at political meetings or any march, demonstration, or another event of a political nature
