Machakos Governor Alfred Mutua has been dealt a blow after the registrar of companies reversed shares he had illegally transferred from his former lover Lilian Ng’ang’a in his bid to push her side from the ownership of their A&L hotel.

In a letter seen by now.co.ke, investigations of the saga between the two regarding the transfer of shares indicated that Ng’ang’a did not consent to the transfers of shares nor was she aware of the resolutions on the transfers.

"The registrar finds that there is a reason to invoke the provisions of section 862 of the companies Act 2015, and thereby notifies the parties that the impugned changes have been expunged from the register and the ownership of the company restored to the shareholding prior to the changes lodged with the registrar on August 11, 2021," the letter reads in parts.

Prior to the new development, Ng’ang’a had filed a complaint to the registrar of companies through her lawyer Philip Murgor stating that after their separation, the governor had allegedly reallocated some 1,800 shares she owned at Ndash Enterprises which owns the hotel located in Machakos.

Mr. Murgor said the registrar found merit in the complaint dated November 11, 2021, alleging that the entry of the company was reversed and there was a fraudulent transfer of the 1800 shares which currently indicates that the two own 2000 shares each.

Currently, Ng’ang’a through her lawyers is asking the DCI to conduct investigations into what they termed a criminal transfer of the shares.

In the same complaint, Ng’ang’a argued that Mutua took away her car, transferring the ownership details to his name.

“Ng’ang’a remains hopeful that the investigations by the DCI into the criminal aspects of the fraudulent transfer of her shares and her motor vehicle can be concluded expeditiously and [the file] forwarded to the DPP for appropriate action,” Murgor stated.
