A court on Thursday, May 19 has established that Kapsaret MP Oscar Sudi is in the country, contrary to initial information by his lawyers that he was on a medical trip in Turkey.

According to the court, the legislator is in fact in Eldoret, after his legal team failed to substantiate the claims that he had failed to appear for the hearing of his forgery case on Wednesday, May 19 because he had traveled to Turkey to seek medical treatment.

Lawyers Thomas Ruto, Collins Kiprono and George Wajakoyah presented documents trying to prove that their client had indeed traveled, which the Magistrate Felix Kombo questioned over their authenticity.

The court had to be temporarily adjourned after Wajackoya and his co-counsel rushed to the embassy to secure the said documents which still did not satisfy the court, to the lawyers responded that it was possible that Sudi's flight may have either been delayed or canceled.

"It is also now clear that your client did not travel. Why did you say he traveled? If he gave you instructions that were not true, tell me and leave it to the court," said Kombo.

"These documents still don't show a specific address where the hospital is located," Kombo said.

Further, a poser arose from the medical documents signed by one Austin Okoth, with Lawyer Kiprono having a difficult time confirming whether Okoth as a signatory of the diagnosis was a doctor.

It was later established that he was a certified doctor and had no problem with the same being verified.

Kombo subsequently directed the case proceeds to hearing in the absence of the MP and his lawyers did not object to the same.

The first witness is expected to take the stand in the case where Sudi is accused of forging his academic documents from various institutions in the country.
