The Independent Electoral and Boundaries Commission (IEBC)  is facing a serious dilemma over various filed cases in courts from the candidates seeking clearance to contest.

The electoral commission has on Friday expressed its pleasure with the pending cases in court  calling on Judiciary to give direction.

Following this Chebukati now wants the Chief Justice Martha Koome to expedite the determination of the cases to avoid a delay in the ballot printing process.

As it stands at least thirty one areas within Nairobi, Mombasa, Kiambu and other counties may be affected by IEBC decision. 

In a statement on July 7, the electoral body noted that the logistical arrangements required that all election materials including ballot papers are distributed on time during the polling day at each polling station.

This is, however, largely dependent on determination of those petitions.

" The commission notes with concern that these critical processed could be hampered by unconclude Court cases and cases in which orders have been issued stopping the printing of ballot papers among others," said Chebukati.

IEBC stated that this is likely to compromise the conduct of the August 9, polls.

The commission  concluded  registration of candidates June 6, followed by resolution of disputes arising from the decisions made by the returning officers either by registering or declining to register a candidate.

325 cases were filled out of which 39 of the complaints were allowed in, according to the IEBC.

It added that 269 were dismissed while 17 were withdrawal.

IEBC, however has welcomed the petitions from the aggrieved candidates urging them to move to court to review the decisions of the committee.

According to Chair Wafula Chebukati only 31 cases have proceeded to the High Court as of Thursday, July 7.

He said 325 cases were heard and determined by the Dispute Resolution Committee (DRC).

IEBC received the first batch of ballot papers of 128 pellets at Jomo Kenyatta International Airport (JKIA).
