Mr.Chebukati Caught Between A Rock and A Hard Place.

Chebukati yet again is embroiled in a bitter struggle for power between Raila Odinga of Azimio One Kenya Party and UDA’s William Ruto.

Accusations and counter-accusations have been made to this man the IEBC chair and National Returning Officer.


As the chair of the IEBC, his mandate according to the constitution includes declaring the winner of a presidential election and delivering a notification of the same to the Chief Justice and outgoing President in this case Uhuru Kenyatta.


Two times in a row his leadership capacity and style have been questioned. The first time in the 2017  presidential elections which ended in nullification and the 2022 presidential elections that have today 22nd August 2022, been petitioned in the Supreme court.


“In  2017, this Court was too shy and spared the 2nd respondent herein who was also the chairperson of the IEBC then from direct responsibility and culpability for the bungled and impugned election. That decision as this petition will show emboldened a rogue public officer who with willful, fraudulent, and criminal intent set out to subvert the sovereign will of the people of Kenya and the constitutional order of the presidential election.”Stated part of the petition filed today with Wafula Chebukati as 2nd respondent.


Wafula Chebukati has been accused of operating outside the law and willfully subverting the will of the people.


IEBC chair has also been accused of disregarding the law and operating outside the confines of the constitution including observance of democratic values and principles.


Wafula Chebukati is also accused of disagreeing with critical members of the commission. This includes Patricia Akombe who resigned in 2017, Margaret Mwachanya, Connie Maina, and Paul Kurgat. Recently four commissioners have also dissented from the commission. The four include Juliana Cherera, Francis Wanderi, Justus Nyang’aya, and Irene Masit.


Wafula Chebukati will be held liable for unilaterally announcing the outcome of the presidential election without tallying and verifying of results from 27 constituencies whose results would affect the final outcome.


The IEBC chair is also allegedly responsible for declaring a false outcome.


He also, without reason refused to share the final results with presidential agents the final presidential tally.


Petitioners also contend that Chebukati aided in the setting up; and therefore compromised the security of the electoral process and systems to fraudulently manipulate the presidential election results.
