Sakaja's Bid Saved by High Court For Nairobi Guberntorial Seat

The High Court has on Tuesday July 12, dismissed petition seeking Johnson Sakaja's disqualification from the governor's race over the validity of his academic papers.

In his ruling, Justice Anthony Mrima faulted the Independent Electoral and Boundaries Commission (IEBC) over validity of Senator Sakaja saying the commission lacked sufficient evidence.

"The court finds IEBC did not err in clearing Sakaja to vie for the Nairobi gubernatorial seat. The upshot, therefore, is that the petition is unsuccessful and is hereby dismissed with cost," the judge ruled.

Mrima's verdict comes days after Sakaja was listed in the Nairobi gubernatorial race.

In a gazette notice backdated to 30th June 2022, IEBC made public the gazzeted list of candidates in the elective seats who will participate in the August elections.

According to the law, Sakaja  remained a bonafide candidate to participate since the Independent Electoral and Boundaries Commission (IEBC) dispute resolution committee upheld his clearance after a petitioner sought to have him barred over his academic credentials.

The same petitioner, Dennis Wahome, moved to the High Court to seek a review where he wanted the court to bar the electoral agency from printing ballot papers for Nairobi until the case is heard and determined.
