Monday 5th is upon us, the day set aside by the Kenyan constitution to determine the verdict of the Supreme Court of Kenya regarding the presidential election petition following the August 9 elections.

All eyes are now fixed on the seven-judge bench set to deliver their ruling by the end of today.

The Supreme Court retired on Friday after hearing submissions and pieces of evidence from both the petitioners and the respondents.

Key to note, the ruling of the Supreme Court is final because it is the apex court in the land. There is absolutely no room for appeal. The apex court is bound by the constitution even as it exercises its judicious independence.

However, both divides have publicly admitted that they will accept the ruling of the Supreme Court and called upon their supporters to maintain peace and calm after the ruling.

According to the provisions in the law of the land, the Supreme Court will make either of the following rulings;

Dismissing the election petition

The petition of Azimio team leader Raila Odinga may be dismissed thereby upholding the declaration of William Samoei Ruto as the president-elect.

Upholding the  victory of William Samoei Ruto

 If the grounds presented by the Azimio coalition fail to meet the minimum threshold required to warrant a nullification of the recently concluded elections, Ruto’s victory might be upheld by the Supreme Court of Kenya.

Facilitation of fees

The Supreme Court is also set to announce who to foot the costs of the petition which amounts to hundreds of millions of shillings.

In addition, the Supreme Court may make any other ruling that it may deem judicious.

Judges can either come up with a singular unanimous decision or read their individual statements in n open court.

If the victory of William Ruto is upheld by the courts then he will be sworn in as the fifth president within seven days of the apex court declaring its verdict. This would be on 13th September 2022.

If the court nullifies the August 9 2022 election, then a fresh set of elections shall be arranged within sixty days as Uhuru Kenyatta continues to serve in temporary incumbency otherwise known as caretaker president.
