List Of Aspirants Disqualified From Polls By Chebukati

The Independent Electoral and Boundaries Commission (IEBC) on Saturday, June 4 released the names of aspirants who have been blocked from vying in the August 9 elections over different issues such as impeachment, conviction and irregular certificates as had been highlighted by the Ethics and Anti-Corruption Commission.

This was after the electoral body scanned the list forwarded by the EACC of 241 names of those dogged by the issues and placed them in different categories which were those who had cases under investigation, prosecution, convicted without appeal and those convicted and pursuing an appeal.

Under the section of cases still under investigations were cases of acquitted persons, aspirants lacking required academic qualifications and cases of impeached aspirants. 

IEBC hence flagged various aspirants who had been convicted without appeals, candidates who had been impeached from office, those without the required academic qualification and the public officers who failed to resign by the stipulated dates

Those who were locked out of the race owing to impeachment include:

1. Mike Mbuvi Sonko
Sonko was ousted from the Nairobi Governor office in 2019 over allegations of abuse of office among other charges and his case is still in court pending verdict.
He was seeking the Mombasa gubernatorial seat under the Wiper Party ticket.

2. Paul Karungo wa Thang'wa
The vocal UDA leader and Kiambu senatorial hopeful was impeached from office when he was Kiambu Youth Executive over allegations of embezzlement of funds.

3. Anthony Chitavi Mkhala
Chitavi was also eyeing Mombasa governorship but was kicked out of office over charges of abuse of office and was convicted on three counts in December 2011.

According to Chebukati, the three were disqualifies on grounds that being ousted from office contravenes Article 75(3) which states: “A person who is removed from office on contravention of Chapter 6 of the Constitution is disqualified from holding any other State or public office whether elective or appointive.”

Those locked out over invalid academic certificates include:
1. Thuo Mathenge
The Nyeri gubernatorial aspirant's university degree certificate was declared invalid in 2013, and was disqualified from vying in the 2017 elections. This time he still did not make the cut.

2. Ekamais Jeremiah Loromukai
Loromukai's certificates were also considered invalid and this led to his disqualification from the Turkana Gubernatorial seat.

The IEBC also maintained that persons who sought the President, Deputy President, Governor and Deputy Governor seat would only sail through if they possessed a degree from a university recognized in Kenya in accordance with the Section 22(2) of the Elections Act.

Candidates who were disqualified on grounds of conviction without pursuit of appeal include Karen MCA David Njilithia Mberia who was seeking to defend his seat on the August election. In 2021, Mberia was convicted on three counts of soliciting for a bribe and receiving treated money from the EACC.

Chebukati further stated that public officers who did not resign by February 9 will not be cleared.

He also stated that this list has not been concluded as of yet as the registration of candidates was still being verified by the IEBC and hence would be revealed after the close of the registration of candidates.
