Rape Case Against Mithika Linturi Withdrawn


A woman that had filed attempted rape charges against Cabinet Secretary for Agriculture nominee has today dropped the charges in Milimani law courts.

The Chief Magistrate allowed the withdrawal of the case after confirmation of the Director of Public Prosecution confirmed that he was aware.


Chief Magistrate withdrew the case under the section 40 of the sexual offences Act.


Muthomi Thiankolu, the former senator's lawyer told the court that the two parties had come to a consensus and that the woman had filed an affidavit to have the case withdrawn from court.

State Counsel Nyakira Kibera also authenticated that the woman had agreed to drop the charges and withdraw the case against the former Senator.


The woman also confirmed to the court that they had reached an argument with Mithika Linturi.


Upon examination by the prosecution, the woman revealed that the decision to withdraw the case was not done under coercion but voluntarily.

The woman took swore an oath confirming that the decision was not a result of undue or external interference.


The court also directed that Mithika Linturi’s cash bail amounting to two hundred thousand be reimbursed. The court also directed that the extra two hundred thousand taken as exhibit be given back to him.


The court further directed that exhibits confiscated by the court be returned to the respective parties.


In January 2021, Mithika Linturi was accused of attempted rape.

The complainant accused him of sneaking into her hotel room at Maiyan Villa Nanyuki.


The former Meru senator denied the charges and stated that the move was politically instigated by his political opponents. 


In his submissions. Linturi’s lawyer Muthomi Thiankolu appealed to the court to dismiss the case due to a lack of sufficient evidence(nude photos and videos).


While speaking at an interview yesterday deputy president Rigathi Gachagua stated that any state officer convicted in court for a criminal offense will be required to leave office.


However, on the question of nomination of cabinet secretaries with ongoing cases, he upheld that most of the accusations were political and sooner or later the politicians would be acquitted.
